1. Who we are
CheapWills is a trading name of Nesbitt Web Ltd, company number 09417982, registered in England and Wales at 27 Old Gloucester Street, London, WC1N 3AX. In these Terms, "we", "us", and "our" refers to Nesbitt Web Ltd. "You" and "your" refers to you, the customer.
2. What the Service does
CheapWills is an online will writing tool. You answer a guided questionnaire and the Service generates a will document based on your answers. You download, print, and sign the document in the presence of two witnesses in accordance with the Wills Act 1837.
The Service is not legal advice. We provide a tool to help you create a will. If your circumstances are complex (for example, business assets, trusts, overseas property, or blended families), you should seek independent legal advice from a qualified solicitor.
3. Your account
3.1 You must provide accurate information when creating your account.
3.2 You are responsible for keeping your login credentials confidential. Let us know at [email protected] if you suspect any unauthorised access.
3.3 You must be at least 18 years old to use the Service.
4. Your responsibilities
4.1 You are solely responsible for the accuracy of the information you enter. The will document is only as good as the information you provide.
4.2 You are responsible for correctly printing, signing, and witnessing your will in accordance with the law. An unsigned or improperly witnessed will is not legally valid.
4.3 You should review your will regularly and update it after major life events such as marriage, divorce, the birth of a child, or a significant change in assets. Marriage automatically revokes an existing will in England and Wales.
4.4 We strongly recommend you store your signed will in a safe place and tell your executors where to find it.
5. Fees and payment
5.1 Prices are displayed during checkout and are in pounds sterling. Currently: £9.99 for a single will, £14.99 for mirror wills.
5.2 Payment is a one-off charge for generating your will document. There is no automatic subscription or recurring billing unless you separately opt into an update plan.
5.3 We may change our pricing at any time. Any change will not affect purchases you have already made.
5.4 Refunds are handled on a case-by-case basis. If you have not yet downloaded your will document, contact us and we will do our best to resolve the issue. Statutory consumer rights are not affected.
6. Intellectual property
6.1 All intellectual property in the Service, software, and will templates belongs to Nesbitt Web Ltd.
6.2 The will document generated for you is yours. You may print, copy, and distribute it as needed for your personal estate planning.
6.3 You may not copy, reverse engineer, or redistribute the Service itself, or use it to build a competing product.
7. Data and privacy
Your use of the Service is subject to our Privacy Policy, which forms part of these Terms. We take the security of your personal data seriously — will-related information is sensitive and we treat it accordingly.
8. Limitation of liability
8.1 Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, or for fraud.
8.2 Subject to 8.1, we are not liable for:
- any indirect or consequential losses;
- the legal validity of your will if it was not properly signed and witnessed;
- any loss arising from incorrect information you entered;
- disputes between beneficiaries or challenges to your will;
- any loss arising from you not updating your will after a change in circumstances.
8.3 Our total liability to you under these Terms shall not exceed the amount you paid us for the Service.
8.4 The Service helps you create a will. It does not guarantee that your will is suitable for your particular circumstances. You use the Service at your own risk and should seek legal advice if in doubt.
9. Termination
9.1 You may close your account at any time by emailing [email protected].
9.2 We may suspend or terminate your account if you breach these Terms.
9.3 On termination, you should ensure you have downloaded any will documents you need. We may delete your account data after 90 days.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.
11. Governing law
These Terms are governed by the law of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.
